MANILA - Atty. Joel Ferrer believes that actress Sunshine Cruz will withdraw the case she filed against his client, actor Cesar Montano.
In an interview on the radio DZMM show "Rated Korina," Ferrer said Cruz might not push through with the case she filed against Montano after they agreed to share custody of their children.
"Sa palagay namin, dahil sa naging arrangement kahapon eh siguro ay hindi na po matutuloy 'yon. If you are referring doon sa criminal complaint at saka 'yung TPO," he said.
Asked if they were told by Cruz's camp that they will withdraw the case, Ferrer replied: "Nai-file na po 'yung 9262, 'yung criminal complaint noon kasabay ng habeas corpus... para ma-preserve 'yung bagay na 'yan na naging arrangement nila. It's a consequence na dapat siguro ay iurong na ang demanda na 'yon."
Montano's lawyer refused to give details about the couple's custody arrangement, citing a gag order.
"Ganito kasi 'yan. Nagkaroon ng gag order kahapon, prohibiting counsel and the parties to talk about the details. Ang pwede ko lang masabi sa inyo ay maganda ang naging solusyon ng judge ukol sa kustodiya. And quoting 'yung Inquirer (newspaper), ngayon ang sinasabi dito 'the couple agreed to share custody of their children.' Base doon ay masaya ang dalawa sa naging resulta," Ferrer said.
On Tuesday, Cruz filed a complaint-affidavit before the Quezon City Regional Trial Court in an Anti-Violence Against Women and their Children case against her husband.
Among the claims the actress made was an alleged incident of rape last May.
Cruz described Montano as "a very domineering, philandering husband that demanded full submission and obedience" from her.
On Wednesday, via a statement, Montano denied the charges cited by Cruz.
"My client vehemently denies the charges and prevarications leveled against him as contained in the complaint of Cruz," Ferrer said.
"We maintain that there is no truth whatsoever that my client abused Cruz whether physical or verbal. The marital rape Cruz is alluding to is simply preposterous," the statement added.
